Judge tosses Democratic Party lawsuit against WikiLeaks and Julian Assange

A federal judge has dismissed a lawsuit by the Democratic National Committee against President Donald Trump’s presidential campaign and its leaders, Russia, WikiLeaks and others related to Russian hacking of Democratic Party computers and dissemination of electronic material stolen to help Trump’s election prospects.

Judge John Koetl, in his ruling Tuesday, said that although the “primary wrongdoer in this alleged criminal enterprise is undoubtedly the Russian Federation,” a lawsuit against that government is barred by the Foreign Sovereign Immunities Act.

“The Russian Federation cannot be sued in the courts of the United States for governmental actions, subject to certain limited exceptions not present in this case, just as the United States government generally cannot be sued in courts abroad for its actions,” Koetl wrote in his ruling in U.S. District Court in Manhattan.

The ruling terminated the DNC’s claims against the Trump campaign, individual members of the campaign, including the president’s son Donald Trump Jr. and son-in-law, Jared Kushner, and the document disclosure group WikiLeaks and its leader Julian Assange for releasing material stolen by the Russian hackers.

Koetl said the Constitution’s First Amendment protects those defendants from such a civil legal claim, just as it protects “press outlets that publish materials of public interest despite defects in the way the materials were obtained, so long as the disseminator did not participate in any wrongdoing in obtaining the materials in the first place.”

Koetl dismissed the lawsuit, which was filed in April 2018, “with prejudice,” which bars the DNS from bringing the same claims against the defendants in another suit.

The DNC had claimed that Russia, whose intelligence operatives in 2016 infiltrated the computers of the Democratic Party and the campaign of its eventual presidential nominee, Hillary Clinton, had found in the Trump campaign “a willing and active partner in its effort.”

Sarah Matthews, a spokeswoman for Trump’s campaign, in an email statement about Koetl’s ruling, said, “Yesterday was a huge victory in court for the President who has once again been exonerated from another baseless Russian collusion allegation.”

“This was a sham lawsuit filed by a desperate, dysfunctional, and nearly bankrupt Democratic Party,” Matthews said. “While Democrats still can’t get their heads around their poor performance in 2016, President Trump has been focusing his energy on putting America and Americans first.”

Some — including Bernie Sanders supporters — suspect the Clintons were behind the deaths, just more episodes in the alleged “Clinton body count” dating back to the 1990s. Others dismiss the speculation as left-wing conspiracy nuts. But until the police have completed their investigations and the medical examiners have released autopsy reports, it is premature to make any determinations. Seth Rich DNC staffer Seth Rich was mysteriously murdered in the streets of Washington, D.C., on July 10. Although it is being investigated as a robbery, his wallet, credit cards and watch were not taken. The 27-year old was shot in the back on July 10 at 4:15 a.m. near his affluent neighborhood, while he was reportedly walking home from his girlfriend’s apartment. Police still have no suspects, witnesses or motive. His mother told the local NBC station that there were bruises on his face, knees and hands, apparently from trying to fend off his attackers. Some are speculating that Hillary Clinton is behind the murder, because Rich could have been the DNC staffer responsible for leaking the 20,000 damaging DNC emails to Wikileaks. The allegation is that powerful Sanders allies convinced Rich to leak the data. He had previously worked on the U.S. Senate campaign for Nebraska businessman Scott Kleeb, who lost his election. The Clinton Global Initiative provided funds for a clean energy business started by Kleeb, which had come under investigation after losing $300,000 in 2010 and another $300,000 in 2011 despite the subsidies. Rich was also previously employed at a data firm that had worked with the Clintons. After news of possible corruption emerged between the Clinton Global Initiative and Kleeb, supposedly that led to Sanders’ cronies pressuring Rich to leak what was going on. Rich was a data analyst, so it is very possible he could have had access to the DNC’s emails. Julian Assange of Wikileaks said recently on TV that it wasn’t Russian hackers who intercepted the emails, as the Hillary Clinton campaign has alleged; instead, any one of a number of staffers within the DNC could have leaked them. Wikileaks has obtained and decrypted this previously unreleased video footage from a US Apache helicopter in 2007. It shows Reuters journalist Namir Noor-Eldeen, driver Saeed Chmagh, and several others as the Apache shoots and kills them in a public square in Eastern Baghdad. They are apparently assumed to be insurgents. After the initial shooting, an unarmed group of adults and children in a minivan arrives on the scene and attempts to transport the wounded. They are fired upon as well. The official statement on this incident initially listed all adults as insurgents and claimed the US military did not know how the deaths ocurred. Wikileaks released this video with transcripts and a package of supporting documents on April 5th 2010 on http://collateralmurder.com

Hours Before His Death Michael Hastings Contacted Wikileaks Attorney Said FBI Was Investigating Him

The organization tweeted to its 1.9 million followers that the award-winning journalist contacted its lawyer shortly before the dramatic accident that took his life.


In a starting series of tweets sent by the WikiLeaks Twitter account, the organization says recently deceased Buzzfeed reporter Michael Hastings contacted one of their lawyers and said the FBI was investigating him.
Hastings has stirred quite a bit of controversy in his relatively short journalism career. His first big story was a profile on Gen. Stanley McChrystal for Rolling Stone magazine, which resulted in President Obama's first scandal and the firing of McChrystal.
It was also reported that Hastings was working on a story regarding the CIA, according to LA Weekly. With Hastings' talent to find groundbreaking stories, he must have been working on something important.
WikiLeaks says that, only a few hours before Hastings' car accident, he contacted WikiLeaks lawyer Jennifer Robinson — a well known lawyer from London — and told her that the FBI was investigating him. Here's the tweet in it's entirety below:

In August 2012, Wikileaks revealed details about a system known as Trapwire that uses facial recognition and other techniques to track and monitor individuals captured on countless different closed-circuit cameras operated by cities and other insititutions. The software is billed as a method by which to prevent terrorism, but can of course also be used to provide unprecedented surveillance and data-mining capabilities to governments, corporations, and other insitutions, including many with a history of using new technologies to violate the rights of citizens. Trapwire is already used in New York, Los Angeles, Las Vegas, Texas, DC, London, and other locales.

The ex-CIA agents who help run the firm are old friends of Stratfor vice president Fred Burton, whom they've briefed on their own capabilities in e-mails obtained by Anonymous hackers and provided to Wikileaks. Stratfor has engaged in at least several surveillance operations against activists, such as those advocating for victims of the Bhopal disaster, on behalf of large U.S. corporatons; Burton himelf was revealed to have advocated "bankrupting" and "ruining the life" of activists like Julian Assange in e-mails to other friends.

Trapwire can be extremely expensive to maintain, and is usually done so at taxpayer expense; Los Angeles county spent over $1.4 million dollars on the software's use in a single three-month period of 2007.

Although most of the regions in which Trapwire operates don't share information with each other, all of this is set to change; as Abraxas Applications president Dan Botsch told Burton via e-mail, "I think over time the different networks will begin to unite," noting that several networks had already begun discussions on merging their information. Abraxas itself has always had the ability to "cross-network matches" from every region at their own office. By June 2011, Washington D.C. police were engaged in a pilot project under the Departent of Homeland Security that's likely to lead to more cities using Trapwire on a more integrated basis.

Abraxas, the firm whose spin-off Abraxas Applications developed Trapwire in 2007, has long been involved in a lesser-known practice known as persona management, which involves the use of fake online "people" to gather intelligence and/or disseminate disinformation. The firm Ntrepid, created by Abraxas owner Cubic Corporation, won a 2010 CENTCOM contract to provide such capabilities for use in foreign countries; several board members of Ntrepid also sit on Abraxas.

WikiLeaks announced tonight that it is publishing documents it is calling "The Global Intelligence Files" which includes over 5 million e-mails from the US-based "Global Intelligence" company Stratfor, the Global Intelligence Company described by Barons as the Shadow CIA, according to a statement the organization released Sunday night.

WikiLeaks has partnered with 25 media organizations to publish the documents including the McClatchy newspapers and Rolling Stone.

"The e-mails date between July 2004 and late December 2011. They reveal the inner workings of a company that fronts as an intelligence publisher, but provides confidential intelligence services to large corporations, such as Bhopal's Dow Chemical Co., Lockheed Martin, Northrop Grumman, Raytheon and government agencies, including the US Department of Homeland Security, the US Marines and the US Defence Intelligence Agency. The emails show Stratfor's web of informers, pay-off structure, payment laundering techniques and psychological methods."

WikiLeaks will hold a noon-time press conference in London on Monday to explain the files. The full press release is available here.

UPDATE: Monday's WikiLeaks London press conference has ended. The New York Times reports:
“The material contains privileged information about the U.S. government’s attacks against Julian Assange and WikiLeaks and Stratfor’s own attempts to subvert WikiLeaks,” the group said. “There are more than 4,000 e-mails mentioning WikiLeaks or Julian Assange.”

At the London news conference, Mr. Assange said the Stratfor statement seemed to confirm the advice offered by a senior figure in the company in one of the exposed e-mails which he quoted a senior Stratfor executive as saying: “admit nothing, deny everything, make counteraccusations.”Mr. Assange appeared Monday at a streamed news conference from the journalists’ Frontline Club in London.

Stratfor said in a statement that some of the e-mails being published “may be forged or altered to include inaccuracies; some may be authentic,” the company said in a statement quoted by Reuters.
“We will not validate either. Nor will we explain the thinking that went into them. Having had our property stolen, we will not be victimized twice by submitting to questioning about them,” the statement said.

At the London news conference, Mr. Assange said the Stratfor statement seemed to confirm the advice offered by a senior figure in the company in one of the exposed e-mails which he quoted a senior Stratfor executive as saying: “admit nothing, deny everything, make counteraccusations.”

Wikileaks has begun publishing 5 million e-mails from Stratfor, the Global Intelligence Company described by Barons as the Shadow CIA.

At 00:01 GMT on 27 February 2011, Wikileaks started publishing the confidential e-mail communications between Stratfor and its informants which includes government employees, government agencies and corporations.

In a press release, the inner workings of Stratfor are described, painting a world where the government, corporations and Stratfor are intertwined.

Anti-Sec, part of Anonymous, proclaimed late in December 2011 that they had hacked into Stratfor and had managed to gain access to subscriber data. In a press release, Anti-Sec stated that the main reason they hacked into Stratfor was not for the subscriber data, but the trove of 5 million e-mail data, which would reveal the inner working of Stratfor and government agencies. It seems that it is these e-mails that are now being leaked by Wikileaks.

The latest leak from Wikileaks is bound to raise uncomfortable questions. One needs to ask, why did Anti-Sec decide to give this data to Wikileaks rather than release it themselves as they usually do with other data? Is there – some may question – a connection between Wikileaks and Anti–Sec? On the other hand, some may ask whether Anti-Sec is a covert operation which has decided to leak this information to Wikileaks precisely so that individuals can make these connections and raise these questions, with the ultimate aim of tarnishing the reputation of Wikileaks further.

We do not know. What is certain is that this latest revelation is bound to be extremely revealing.
